1. GENERAL

By using The Fig & Fox Company website, you agree to be bound by the terms and conditions set out within it. Nothing in these terms and conditions affects your statutory rights as a consumer, or otherwise.

Any liability under these terms and conditions cannot exceed the total price of your order.

The Fig & Fox Company is not responsible for any business loss or damage which does not result directly from their actions, or that was unforeseeable at the time of ordering.

2. PLACING AN ORDER

When you place an order via our website, it is classed as an offer, which if accepted by us results in a binding contract. By completing the checkout process on The Fig & Fox Company website, you are also agreeing to all of our Terms and Conditions as presented on the website.

Should we accept your order, you will be sent an email containing the details of your order. Once this email has been sent, it means the order has been accepted, a contract has been formed, and payment will be taken. If, in the unlikely event, your order is not accepted, we will notify you via email of why this is the case, and no payment will be taken.

It is your responsibility to check all the information in the confirmation email is correct, and notify us immediately via email to hello@thefigandfoxcompany.co.uk should there be any inaccuracies. We will not be liable for reimbursing you for the value of any goods which have perished or been damaged as a result of your failure to inform us of inaccurate information being listed on the confirmation email.

3. CANCELLING AN ORDER

Should you wish to cancel an order that has been accepted by us, and a confirmation email has already been sent out to you, we are unable to guarantee that we can cancel the order, and provide a full refund. However, if you email us as soon as possible, and your items have not yet been dispatched, we will endeavour to cancel your order and refund you in full without charge. In cases where your box has already been packaged though, this will not be possible.

4. PRODUCT DESCRIPTION

All of our product images are for illustrative purposed only. Therefore packaging and presentation may vary slightly and is subject to change at any time.

The products in our subscription box are changed on a monthly basis with a direct debit taken on the day you first made your purchase. As such, items expected in this product are not specified on our website through imagery or text. We do however try to give an indication of what can be expected and from time to time we may reveal upcoming items on our website or social media.

 

We reserve the right to deliver products that have not be indicated and replace any originally listed items with a suitable alternative.

We strive to accommodate preferences and dietary requirements for all of our customers. However, unless the option is specified by us in the product description then we cannot guarantee we are able to adapt our boxes to suit your preferences.

5. DELIVERY

We deliver all of our subscription boxes ourselves. In doing so, we can remain competitively priced and not charge our customers large courier fees. However, as we do not use a courier and are a small business, we currently only deliver this service within a 20 mile radius of Peterborough on set days. Please refer to our delivery information here for more details.

 

Before completing your purchase, you must indicate a 'safe place' for us to leave your box in the event that nobody is present to receive the subscription box. This is not a signed for service and recommend you give instructions for a place that is out of direct sunlight and the public eye. Please note that we do not assume liability for loss or damage incurred as a result of the box being left at this location if it is not secure. If we do not deem it to be safe, we may refuse the delivery and contact you regarding a redelivery via text or email with the details you have provided. A redelivery may incur additional delivery fees if it cannot be reattempted that same day to ensure the freshness of products inside of it.

We offer our limited edition gift boxes with free U.K. delivery unless specified otherwise. At present (November 2020) we use Royal Mail and customers can expect their gift within 5-7 working days unless this is a pre-order item. Pre-ordered items will specify a dispatch date from which the item can expect to arrive within 2-3 business days. If you require your purchase sooner, please get in touch with us to see if it is possible to arrange this.

If you are not in to receive your delivery and it is left in your 'safe place' then we recommend you return to open your delivery within 24 hours. Products inside meal kits, and at times our other boxes, will need to be refrigerated or even frozen straight away. Our boxes are designed to maintain food in the right conditions for up to 48 hours but this is including from the time of dispatch and from the time of delivery.

If there is nobody available to receive the delivery or a safe place for it to be left on the same day then we cannot guarantee we are able to redeliver. As such, we are unable to offer any refund or compensation due to the loss of perishable items inside the box. It is therefore imperative that you ensure someone is available to receive your delivery on the day specified in our delivery schedule.

6. ROLLING SUBSCRIPTIONS

Payment for rolling subscriptions (the Discovery Box) will always be taken from the credit or debit card you used to sign up. It will be taken on the same date each month (the date you signed up) unless you change this. Rolling subscriptions must be cancelled 1 week prior to your payment date. We are unable to cancel your subscription box delivery if you cancel after this period. If cancellation is made at least 1 week in advance of your billing date, your subscription will be cancelled free of charge. You can cancel by emailing us at hello@thefigandfoxcompany.co.uk.

7. PACKAGING SAFETY & DISPOSAL

Our cardboard delivery boxes are recyclable and biodegradable including any kraft tape. Our boxes also contain wood cool to cushion the contents of the boxes, tissue paper and cotton/jute string; all of these elements are compostable at home. We would advise keeping all these components out of reach of children, and we cannot accept liability for any injuries that may occur that are either directly or indirectly linked to any packaging The Fig & Fox Company delivers to you.

8. COMPLAINTS

All of our products in our subscription boxes and gifts boxes have been sourced by external suppliers abiding to Trading Standards.  They are subject to inspection prior to delivery to ensure it is in optimum condition when it is dispatched.

 

In the unlikely event that you are unhappy with the condition of any of the products that you receive, please let us know immediately and do not contact its source supplier directly. Please email us with your complaint details, including photographic evidence, and we will take any necessary action.


If you do not inform us of a problem within 5 days of receipt of the order, or you do not provide any photographic evidence relating to the complaint, we will be unable to accept your claim, or provide a refund.

9. GOVERNING LAW

These Terms and Conditions are governed by and written in accordance with the laws of England and Wales. You agree to submit to the non-exclusive jurisdiction of the English courts.
